Terms and Conditions for SubwearXCruise Giveaway

• The Promoter is Subwear, hereinafter referred to as “The Promoter” or “Subwear”.

• The competition is open to all above the age of 18 who are in possession of a valid identity document and passport. 

• Entries received will only be accepted from those who have purchased an item from Subwear’s official online store or official physical store locations and have abided by the competition rules as stated below.

• ​​Entries not associated with the entrant's name will be disqualified.

• A South African passport valid for 6 months after the date of travel (Must not expire before 30 July 2024) will be required for travel and is the sole responsibility of the entrant/s. In the event of a non-South African passport being produced. Visa regulations may apply.

• Travel documentation, requirements and compliance are the sole responsibility of the entrant/s.

• Subwear does not bear any responsibility and/or liability for any and all events/occurrences which can and may arise from the claiming of the prize including any loss, injury or damage which may occur.

• To stand a chance of winning the competition, follow the instructions as specified herein.

The competition mechanic is as follows: 

Purchase any item to the value of R1000 or more, either online or in-store from Subwear during the period beginning 3 November 2023 until the period ending 30 November 2023 and stand a chance to win the prize as specified below. 

• The promoter is not liable for the failure of any technical element relating to this promotional competition that may result in an entry not being submitted.

• It is the responsibility of the entrant to ensure that the store employee has been notified of the entrant's correct identity and contact details when purchasing from a physical store location.

• The prize is:

A 3 (three) night, 4 (four) day ship cruise for the winner and 1 (one) designated guest onboard the MSC Splendida. 

The cruise package includes accommodations, meals, a drinks package (excluding alcohol) and onboard entertainment as specified by the cruise line. 

The ship will depart from Durban, South Africa on 19 January 2024 at 16h00, however passengers need to be onboard before 14h00.

The ship will arrive at the Portuguese Island, Mozambique on 20 January 2024 for the day, and on 21 January 2024 the ship will be at sea.

The ship arrives in Durban, South Africa on 22 January 2024 at 06h00 and disembarkation starts at 07h00.

Only 1 (ONE) winner will be selected (and is designated a spot for their guest).

• Travelfare and expenses required to be at the departure point for the cruise and travel after the cruise is NOT included in the prize and is the sole responsibility of the entrant/winner and their guest.

• Meals and drinks are included (alcohol excluded)

• The departure and arrival dates and times are fixed and cannot be altered, negotiated or otherwise changed by the entrant/winner.

•  The prize is not exchangeable for cash and is not transferable. The Winner will have to claim/accept their prize and provide the necessary details, communications and documentation associated with the acceptance of the prize within 3 days of the draw. Failure to claim the prize or a refusal or inability to comply herewith will disqualify the winner and a new winner will be drawn in their place at the sole discretion of the Promoter.

• The winner will be randomly selected on 15 December 2023 and will be announced on Subwear’s social media platforms. The winner will be required to provide their contact details via private messaging if required. The organisers will also endeavour to contact the winner on the telephone number provided. If, however, they cannot be reached after 3 attempts that have been made during business hours within a period of 72 hours for any reason whatsoever, the prize will be forfeited and another winner will be randomly selected in accordance with the competition rules.

• The Promoter reserves the right to request that content from the winner will be used for publicity purposes in any manner they deem fit, without any further remuneration being made payable to the winner, which request the winner may decline.

The participants entering SubwearXCruise Giveaway confirm that they have read, understood, and accepted the consent to process personal information in terms of the Protection of Personal Information Act, 4 of 2013 by Subwear and will abide by these terms. The entrant's entry into the competition acknowledges acceptance of these terms.

• The Promoter shall have the right to terminate the competition immediately and without notice for any reason beyond its control requiring this. In the event of such termination, all participants agree to waive any rights that they may have in terms of this promotion and acknowledge that they will have no recourse against the Promoter, its agents and staff.

• Participation in the competition constitutes acceptance of the competition rules and entrants agree to abide by the rules.

• Except in so far as is provided for in the Act 68 of 2008, the judges’ decision is final and no correspondence will be entered into.
